1. Acceptance of Terms
By accessing or using the BerthFinder platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
2. Marketplace Disclaimer
BerthFinder is a marketplace. While we verify partners, the final contract of berthing is between the Boater and the Operator.
BerthFinder facilitates introductions and enquiries between boaters and marine operators. We do not own, operate, or manage any marina, berth, or mooring facility listed on the platform. All berthing agreements, pricing, availability, and on-site services are determined solely by the operator.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account, and notify us promptly of any unauthorised use.
4. Operator Partner Obligations
Operator partners ("Verified Partners") are responsible for the accuracy of their listing information, including access models, facilities, and relevant operational details. Partners agree to respond to enquiries in a timely manner and to keep their listing information current. BerthFinder reserves the right to suppress listings that contain materially incorrect information.
5. Fees & Payments
BerthFinder operates on a commercial partner model. Verified Operator Partners pay a subscription fee for representation on the platform. Listing a berth, mooring or slip is free.
We never charge commission on an enquiry. Enquiries go straight to the operator or seller, and nothing is payable whether or not one is answered, replied to, or leads anywhere.
Where BerthFinder introduces a buyer or tenant and that introduction results in a completed sale or letting of a berth, mooring or slip, a success fee may be payable by the seller: 5% of the completed sale price, or of the first year's rent on a letting, with a minimum of £500 on a sale; on a letting the fee is a minimum of £250 and never more than 12.5% of that first year. Renewals carry no fee. Any such fee is agreed in writing with the seller before their listing is published, and is never applied retrospectively. Where no fee has been agreed in writing, none is payable.
Where a marina operator has separately agreed our introduction terms in writing, a success fee is payable when a boater we introduce takes an annual berth or mooring: 5% of the first year only, minimum £250 and never more than 12.5% of that first year. Renewals carry no fee, and nothing is ever payable for an enquiry, an answer, or a visitor stay. Marinas holding an active BerthFinder subscription pay no introduction fees. As above: where no fee has been agreed in writing, none is payable.
Listings published on or before 11 August 2026 carry no success fee of any kind, permanently. Subscription fees and any agreed success fee are disclosed in full before they apply.
6. Boater Responsibilities
Enquiries sent through BerthFinder go directly to the marina. BerthFinder does not guarantee a reply or availability of any berth or mooring. Bookings, payments, and contracts are between the boater and the marina.
7. Limitation of Liability
To the fullest extent permitted by law, BerthFinder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to disputes between boaters and marine operators.
8. Modifications
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email where reasonably possible.
